General Terms and Conditions of Use and Sale

Use

Use of https://www.eredymia.com (the "Site"), published by Eredymia, is subject to these legally binding general terms and conditions (“Terms”). The Site is intended only for use by individuals 13 years of age or older. By using the Site, you acknowledge having read, understood, and accepted without reserve these Terms.

Eredymia may modify and update these Terms anytime; those in effect during your use apply.

Scope and Agreement on Sales

The purchase of products offered for sale on the Site is subject to these Terms and to the applicable, specific terms and conditions of sale (collectively, “Sale Conditions”). 

The Site is strictly for customers intending, representing, and warranting to purchase products for personal use, not commercial resale or other commercial purposes directly or indirectly.

You agree with Eredymia to comply with the Sale Conditions when purchasing and ordering products from the Site; for each order placed, your acceptance of the Sale Conditions in effect on your order date is required.

The Sale Conditions in effect at the time of your order will govern that transaction. Eredymia may update these Sale Conditions anytime without prior notice.

Privacy

Please see our Privacy Policy which governs personal data processing (also linked to in the Site’s footer). Eredymia may update the Site’s Privacy Policy without notice.

Intellectual Property

All Site materials, the gate and welcomer Eredymia logo, domain name “Eredymia.com”, and other Eredymia-related trademarks and logos, whether or not registered, without limit are Eredymia’s sole property. You may not by any means use, reproduce, distribute, publish, transmit, create derivative works based on, modify, remove, or sell any such Site materials, copyright, proprietary notices, or Eredymia trademarks without prior and express approval.

You may make a single copy of webpages published on the Site for your own private, personal and non-commercial use, provided any copy retains all copyright and other proprietary notices.

Linking 

Links to the Site require Eredymia's prior express written approval.

The Site may link to third-party websites and their contents, which Eredymia does not control or endorse expressly or impliedly. 

Placing an Order

You may place your order via the Site. 

For each product on the Site, a summary page will be displayed featuring a photograph of the item, the quantity selected, and its unit price.

Best, reasonable efforts are taken to help ensure the photographs displayed on the Site are representative of the original products. Variations may occur due to technical restrictions of color reproduction on your computer or mobile device, the nature of the product (e.g., plants, ready-to-wear printed to order), and so on.

Eredymia reserves the right to reject or cancel orders in its sole discretion for any reason without liability if, among other things: 

• the products are not available, incorrectly priced, or otherwise incorrectly described;

• the order was placed by a customer with whom Eredymia has a dispute concerning a prior order;

• Eredymia has reasonable cause to suspect that a customer has violated these Sale Conditions or has engaged in any fraudulent activity; 

• or for any other legitimate business reason.

Products Availability

Products offered for sale and displayed on the Site are subject to availability. 

To improve our quality service and help ensure greater availability of our products for each customer, Eredymia reserves the right to limit the number of products which can be purchased per customer. 

Eredymia will not be liable in case of stock outage or unavailability of products.  

Eredymia reserves the right to change the products offered for sale on the Site at any time and without notice. 

In case a product is not available after you have placed your order, we will inform you by email as soon as possible. If your order is canceled by Eredymia, you will be refunded to your original payment method. 

Our plant merchant replenishes inventory weekly between Wednesday and Friday. If a plant is sold out for a period, a refund will be issued for that out-of-stock plant.

Order Confirmation

After you click on the payment button at checkout, your order will be confirmed and submitted to Eredymia’s merchants for processing. 

Once submitted for processing, you may not make any changes to or cancel the order, except as expressly provided in these Sale Conditions or applicable law. 

The confirmation of your order means your acceptance of the Sale Conditions. 

You will receive an order summary by e-mail. 

Requests for plant order modifications must be submitted within 24 hours of order processing to be considered.

Price Payment

All prices of Eredymia products are indicated in US dollars.

Eredymia reserves the right to modify the prices of products offered on the Site at any time without prior notice. 

You will be charged the prices displayed on the Site at the time your order was confirmed provided the product ordered is available. 

Payment is due immediately upon confirmation of your order. 

All orders are payable in US dollars. We accept the following charge (debit) cards and credit cards: Visa®, Mastercard®, American Express®, Discover®, and Diners Club®/Carte Blanche®. Your order will only be shipped once we have verified your payment method and received authorization to process your payment. 

The services “3D Secure” and “American Express SafeKey" are implemented on the Site. They protect credit and debit cards from unauthorized use when shopping. You may be automatically prompted to verify your identity during checkout.

Payment by PayPal®: We accept payments through Paypal®. When completing your order, you will be automatically redirected to the PayPal® platform in which you will need to log in to your account. If you do not have a PayPal® account, you will be able to create one. After the validation of your order with PayPal®, you will be redirected to the confirmation page of Eredymia.com. 

Payment by Apple Pay®: We accept payments through Apple Pay®. This method of payment is compatible with Apple devices on which you have entered your information in the Apple Pay® application. Before confirming the payment, please verify that the information linked to your Apple account is correct, in particular the delivery address provided. Eredymia will not be responsible for replacement or refund of the products if the information provided on your Apple account is incorrect. You must then confirm your order using the Touch ID or other authentication. When completing your order, you will be redirected to the confirmation page of Eredymia.com.

Shipping and Delivery

Shipping rates are calculated at checkout based on product weight and delivery address. 

Products will be shipped to the delivery address(es) specified during the ordering process provided such is(are) located within the Delivery Zone. Any address located outside the Delivery Zone will be refused.

Products purchased via the Site may only be delivered to a physical street address within the Delivery Zone. 

Eredymia's fulfillment partners handle shipping. Delivery times vary by carrier, destination, and inventory availability. 

Eredymia is not liable for shipping delays, carrier issues, or products damaged after handover to the carrier.

Any failure to deliver or late delivery should be reported to Customer Service as soon as possible. For your claim to be accepted, please notify us within thirty (30) business days from the date of your order confirmation.

Upon confirmation of delivery, you (customer) become responsible for the property and assume all risks, including but not limited to loss, theft, damage, or deterioration.

The Delivery Zone for plant products ordered via the Site is restricted to the conterminous United States (the continental U.S.—the 48 contiguous states, excluding Alaska, Hawaii, and all other U.S. territories). 

Requests for plant delivery address changes or custom handling must be submitted within 24 hours of order processing to be considered.

Plant customers must add Winter Shipping Protection to orders if the average daytime temperature in the destination area drops below 45°F. Orders shipped without this protection are not eligible for refunds or replacements if plant damage occurs due to cold exposure; Eredymia will not be liable.

Orders returned to our merchant's greenhouses due to incorrect shipping addresses are not eligible for replacement or refund.

Refunds and Replacements

If plant products arrive damaged due to factors within our merchant’s control, customers may request a refund or replacement. For single-item orders, we issue a full refund if the item is damaged. 

For orders containing multiple plant products where only a portion is affected, the refund is limited to the damaged items. Shipping and handling costs are not refunded unless all items in the order were affected. 

To initiate a refund or replacement request, customers must send their order number, shipping information, and clear photographs of the damaged plant product(s) via our contact form.

Disclaimer of Warranty

The Site and its listed products are provided "as is" and "as available". Eredymia, to the fullest extent permitted by law, expressly disclaims all express or implied warranties of any kind, as well as liability for defects, with no representations, including but not limited to: 

• freedom from viruses or other destructive material, 

• accuracy, 

• currentness, 

• quality, 

• completeness, 

• merchantability, 

• fitness for a particular purpose, 

• non-infringement, 

• workman-like efforts, 

• title, 

• or statutory compliance. 

Limitation of Liability 

Eredymia, to the fullest extent permitted by law, will not be liable to you or third parties for indirect, incidental, special, or consequential damages, including without limitation, loss of profits or other indirect losses, arising out of or in connection with your use or inability to use the Site. 

In case of a dispute between Eredymia and its customer relating to a transaction entered into using the Site, the computerized Site data constitutes the terms of the transaction(s) and will be the proof of communication, orders, and payments between the parties. 

Governing Law and Disputes

These Terms are governed by Delaware law, without regard to conflict of laws principles. You hereby agree, to the fullest extent permitted by law, that Delaware State and Federal courts will have exclusive jurisdiction over disputes. Eredymia will be entitled to seek and obtain injunctive relief or other equitable relief to protect its rights.

Waiver 

Eredymia's failure to enforce any part of these Terms does not waive any of its rights for past or future acts.

Severability

Should any part of these Terms be found invalid, illegal or unenforceable, the remaining parts will be in full force and effect.
